Herewith I forward to your Excellency a minute of the Registrar, Mr. Wise, and letter of explanation by certain officers of the Court with reference to the excision from the Summary Jurisdiction official cause list for Friday last of case No. 1164 of 1895.
The practice of the Court is as follows:- On Friday in each week the Judge sits to dispose of the list of cases for the week. The list is prepared on Thursday afternoon, signed by the Registrar and posted on the Court House door at 4 p.m. on the same day. A Defendant who pays the debt and costs of the Summons into Court before the list is signed is absolved from further costs, but if the case gets into the list he is liable, if judgment passes against him, to pay the hearing fee, and, if a Solicitor is engaged by the Plaintiff, the Solicitor's costs as well.
Mr. Rahulan's statement that when he excluded his brother's case from the list he had the money ($123.50) in his pocket is, I think, probably not quite correct. If he had the whole of the money he could have paid it to the Shroff then and there and there would have been no reason for...
